The Finapps portal has been designed to enable the user to submit client information to Finapps Pty Ltd (Finapps) for the purpose of Finapps considering the client for Finance & Leasing.
Finapps grants you a non-exclusive, non-transferable licence to access and use the Finapps portal in accordance with these terms and conditions of use.
These terms and conditions of use (as amended from time to time) govern the use of the Finapps portal. By clicking "I Agree" button you understand and agree to these terms and conditions of use.
Finapps may change these terms and conditions of use at any time, and may do so without giving you any prior notice.
The user and or user related entities or persons must ensure by having access to the data is authorised to access this data. If the user is not authorised to access the data, the user and its related parties is solely responsible for and indemnifies Finapps in respect of , any loss which a third party causes whilst using the users access data without any authority. The user may grant access to a related party in an "Authorised User" capacity in the Finapps portal by creating an additional user in the Finapps portal that will have its own login credentials. It is the sole responsibility and obligation of the user and its related entities or persons to keep secure and protect the access data from unauthorised use which extends to authorised users of the Finapps portal.
The user is prohibited from engaging in any activities, in the portal or use of the portal that would be deemed unlawful in any way. This includes and is not limited to use of unauthorised third party personal information, supply of incorrect user information and or fraud.
Finapps is not obliged to provide any direction, training or guidance in this regard.
Finapps will at all times make its best endeavours to ensure that the portal is operational and available for use however in some cases the accessibility of the portal will be determined by the availability of related services and computer systems. Finapps makes no warranties in regards to the access and availability of the portal. Finapps will always to the best of its ability notify you in advance of any planned system outages.
Finapps & the User may terminate the access and or use of the Finapps portal by giving One Month's written notice. Access to the portal to the user will cease immediately after this period.
Finapps may at any time at its sole discretion without any prior notice temporarily or permanently block or restrict the use & access of the Finapps portal to the user if;
If Finapps restricts or cancels the users access it will inform the user via email. In the event that the restriction or cancellation is indefinite, The user will loose all access to the Finapps portal and will not be permitted to gain access in any way
Assignment of any rights granted to the user by Finapps in regards to access and use of the portal is at the sole and absolute discretion of Finapps and may otherwise not be transferred or assigned.
Access and use of the Finapps portal is governed by the courts and law of New South Wales.
Finapps will be in no way liable for any loss, damage or injury arising as a result of your use or reliance on the Finapps portal, nor will it be liable for any indirect or consequential punitive or special damages or loss of profit.
Finapps will be in no way liable for any loss, damage or injury arising as a result of, or in part by, its negligent acts or omissions in procuring, compiling, collecting, interpreting, reporting, communicating or delivering any information through the Finapps Portal with the exception of Consumer Guarantees.
All content not limited to forms, contractual documentation and any other information or content that is held or displayed in the Finapps portal is the property of Finapps and subject to National and International Copyright and trademark.
The use of content that is displayed and available in the Finapps portal may only be used by the user under the guise and scope for which access has been provided to the user.
The user is not permitted to republish, reproduce, amend or incorporate any content that is available or displayed in the Finapps portal in any matter or for any purpose. This content is to be used in dealings with Finapps only and is not permitted for use with any other individual, entity or organisation.
